Tenderers are hereby advised that the appointment of an experienced mining and corporate law service provider to conduct a coal mining study and rights application for a period of 12 months has been officially cancelled in line with the 2017 Preferential Procurment Regulation 13.

CHDA, registered as the Chris Hani Development Agency, is a state – owned company (SOC) and is wholly owned by the Chris Hani District Municipality. The CHDA would like to invite bids for “the appointment of the services of an experienced mining and corporate law service provider to conduct a coal mining study and rights application for a period of 12 months”. The service provider will report to the nominated committees to be determined by CHDA from time to time and when requested.

Tenderers shall take note of the following conditions:
- A Functionality pre-qualification will be assessed on the responsive bids. Only bids which earn a minimum of 80% functionality pre-qualification score will qualify for the 80/20 Preferential Points System evaluation.
- The following forms are required to be completed and submitted together with the bid:
- Invitation to tender (MBD1)
- Tax Clearance Certificate or reference PIN (MBD2)
- Declaration of Interest form (MBD4)
- Bidders who wish to claim for preferential points in terms of the Preferential Procurement Regulations, 2017, must also submit a completed form MBD 6.1 as well as an original or certified copy of the proof of B-BBEE status level of contribution (Certificate or Affidavit).
- Declaration of Bidder’s Past Supply Chain Management Practices (MBD8)
- Certificate of Independent Bid Determination (MBD9).
- It should be noted that, in respect of this bid, the 80/20 points system will be applied, 80 being for price and 20 for the B-BBEE status level.
- All bidders must be registered with the Central Supplier Database (CSD).
- Bids must be submitted with a current BBBEE certificate, issued by a certified verification agency or a Sworn Affidavit as failure to do so will result in nil points being scored for BBBEE contribution level.
- All Bids must be submitted with a letter of good standing or latest statement of account for rates/ taxes and services issued by the relevant municipality
- All forms in the Bids documents must be completed in full, as failure to do so may render the submission invalid, or result in disqualification
- All Bids and offered prices are to hold good for a period of 90 days
- All service providers to note that a pre-qualification (functionality assessment) process will be undertaken, prior to preferential points’ system evaluation as part of the selection criteria. All service providers to meet a minimum threshold score of functionality points in order to qualify for the preferential points’ system evaluation.
- Tenderers are urged to sign a tender submission register by the reception area first before depositing the documents in the bid box
- Service providers to note that Bids documents which are late, incomplete, unsigned or submitted by fax or electronically, will not be accepted.
Completed Bids documents must be delivered in a sealed envelope, marked with the BID reference number and description, to the Tender Box in CHDA situated at 15 Warner Street, Southbourne, Queenstown, 5320, not later than, Monday, 14th December 2020, 12:00.
- No late submissions will be considered.
- Failure to provide the mandatory information required in this bid will result in the submissions being deemed null and void and shall be considered non-responsive.
- Telegraphic, telexed, facsimiled or e-mail submissions will not be accepted.
PLEASE NOTE:
- The Bids / EOI documents will be opened in public through live streaming on the CHDA Facebook page and MS Team immediately from 12:00 pm on Monday, 14th December 2020 to adhere/comply with Regulation 3 (Prevention and prohibition of gatherings) of the Regulations issued in terms of Section 27 (2) of the Disaster Management Act of 2002, Gazetted on 18 March 2020;
- No bidders should physically attend a public opening gathering;
- Bidders must view the bid public opening on the CHDA Facebook page and MS Team.
